Understanding Grandparents' Rights in Indiana

The Indiana Grandparent Visitation Act (Indiana Code 31-17-5) permits a grandparent to request court-ordered visitation only under defined circumstances. Grandparents don’t have an automatic right to visitation, and disagreement with a parent’s decision isn’t enough by itself.

Indiana law generally permits a grandparent visitation petition when:

  • The grandparent’s child, who was the child’s parent, is deceased.
  • The child’s parents had their marriage dissolved in Indiana.
  • The child was born out of wedlock.

A paternal grandparent can’t receive visitation under the out-of-wedlock provision unless the child’s father has established paternity. If the child’s parents are married to each other and living together, the Act generally doesn’t authorize a court to override their decision denying grandparent visitation.

How Courts Evaluate Visitation Petitions

A judge may grant visitation when it serves the best interests of the child. The court can consider whether the grandparent has maintained or attempted meaningful contact with the child and may interview the child when appropriate.

Courts begin with a parental rights presumption, which is that a fit parent’s decision is presumed to serve the child’s best interests. The judge must give the parent’s wishes special weight, while the grandparent carries the burden of presenting evidence supporting the requested contact.

A petition is typically filed in the county where the child lives, though prior divorce or paternity proceedings can affect the correct court and filing procedure.
