Post-Decree Modifications

Divorce Modifications Lawyer Serving Zionsville, IN

Coordinated Guidance in Zionsville When a Family Court Order No Longer Fits

A divorce decree or family court order reflects a family’s circumstances at a particular time. When income, parenting schedules, a child’s needs, or living arrangements materially change, we help Zionsville residents evaluate whether Indiana law allows them to seek changes to custody, parenting time, child support, or spousal maintenance.

Law Offices of Eugene Mogilevsky has served Indiana clients since 2014 and has been recognized by ThreeBestRated® and Expertise.com for legal services in Indianapolis. We prepare each case carefully and offer practical advice based on the existing order and the family’s changed circumstances.

Call (317) 743-7958 to schedule a case evaluation and discuss the order you want to change and the circumstances behind your request. Our Zionsville post-decree modifications attorney can advise you.

Indiana Standards for Changing Family Court Orders

The applicable legal standard depends on which part of the order needs to change. Job loss, a significant income shift, relocation, new medical needs, or a different parenting schedule may support a post-decree modification petition, but the evidence must satisfy the relevant Indiana statute.

Child Custody Modification

Under Indiana Code 31-17-2-21, a court may modify custody when the requested change serves the best interests of the child and there has been a substantial change in at least one statutory best-interest factor. We connect the changed circumstances to the factors the judge must evaluate rather than relying on general claims that the current arrangement no longer works.

Parenting Time Modification

Indiana courts may change parenting time when doing so serves the child’s best interests. Restricting a parent’s time generally requires a higher showing, such as evidence that the existing arrangement might endanger the child’s physical health or significantly impair the child’s emotional development.

Child Support Modification

Indiana Code 31-16-8-1 generally provides two paths for changing child support. The first requires a substantial and continuing change that makes the existing order unreasonable. The second, sometimes called the 20% guideline deviation rule, applies when the current amount differs by more than 20% from the Indiana Child Support Guidelines calculation and the order is at least 12 months old.

Income records, employment changes, health insurance expenses, childcare costs, and parenting time overnights can affect this analysis. We review the current order and supporting financial documents to identify the legal basis for the requested change.

Orders Zionsville Families May Seek to Modify

The available options depend on the original order, the circumstances that have changed, and the relief requested. We represent Zionsville residents in matters involving:

  • Child Custody: Requests to change legal custody, physical custody, or the child’s primary residence.
  • Parenting Time: Changes to regular schedules, holidays, transportation arrangements, or other parenting time terms.
  • Child Support: Recalculations based on income, expenses, overnights, or a child’s changing needs.
  • Spousal Maintenance: Requests whose availability depends on the original basis for maintenance and the terms of the decree or agreement.

Relocation can also affect custody and parenting time. A parent planning to move may need to file and serve a relocation notice, after which the other parent may object. The court then considers the child’s best interests and the circumstances surrounding the proposed move.
